1. SCOPE
These Terms apply to orders placed through the Kollateral online store.
By submitting an order, you confirm that you have read and accepted these Terms. If you are purchasing as a consumer, nothing in these Terms limits or excludes any mandatory rights available to you under applicable consumer law.
You must be legally capable of entering into a binding contract. If you are under the age of majority in your country, an order may only be placed with the involvement and authorization of a parent or legal guardian.
2. PRODUCT INFORMATION
We make reasonable efforts to present product descriptions, materials, measurements, colours and images accurately.
Colours and appearance may vary slightly because of lighting, photography, production tolerances and device-display settings. Minor differences that do not affect the essential characteristics or conformity of the product are not considered defects.
Garment measurements may vary within the production tolerances stated on the relevant product page or size guide.
3. AVAILABILITY
All products are subject to availability.
Adding a product to the cart does not reserve it. If a product becomes unavailable after an order is submitted, we will inform you and refund any amount paid for the unavailable item.
We may limit quantities per customer or order where reasonably necessary to prevent fraud, technical errors, unauthorized commercial resale or misuse of the store.
4. PRICES AND CHARGES
Prices are displayed in euros unless otherwise stated.
Displayed prices include VAT where applicable. Delivery charges and any other mandatory charges will be shown before you submit the order.
For deliveries outside the European Union, import duties, taxes, customs-clearance charges and local handling fees are not included unless expressly stated otherwise. These charges are the recipient’s responsibility.
5. PLACING AN ORDER
Before submitting an order, you will be able to review the selected products, sizes, quantities, delivery information and total price.
You are responsible for ensuring that all order and delivery information is complete and accurate.
After an order is submitted, you will receive an electronic acknowledgement. This acknowledgement confirms receipt of the order but does not necessarily mean that the order has been accepted.
A binding sales contract is formed when we send a dispatch confirmation or otherwise expressly confirm acceptance of the order.
6. ORDER ACCEPTANCE AND CANCELLATION BY KOLLATERAL
We may refuse or cancel an order before dispatch where reasonably necessary, including where:
- a product is unavailable;
- payment is not authorized;
- the order contains an obvious pricing or product-information error;
- delivery information is incomplete or invalid;
- fraud, unauthorized payment, abuse or unauthorized commercial resale is reasonably suspected;
- we are unable to deliver to the supplied address.
If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled item or order using the original payment method.
We will not cancel an accepted consumer order arbitrarily.
7. PAYMENT
Available payment methods are shown at checkout.
Payment may be authorized or collected when the order is submitted. You confirm that you are authorized to use the selected payment method and that the information supplied is accurate.
Payment processing may be carried out by third-party payment providers. Their own terms and privacy information may also apply.
8. DELIVERY
Orders are delivered to the address supplied during checkout.
Estimated processing and delivery times are stated in our Shipping & Returns Policy. Delivery estimates are not guaranteed dates unless expressly stated otherwise.
Delays may occur because of high-demand periods, public holidays, carrier disruption, customs procedures, remote destinations or circumstances outside our reasonable control.
You must provide complete and accurate delivery information. Address changes are not guaranteed after an order has been confirmed.
9. INTERNATIONAL ORDERS AND CUSTOMS
Orders delivered outside the European Union may be subject to import duties, taxes, customs-clearance charges and local handling fees.
These charges are not controlled by Kollateral and must be paid by the recipient. The recipient is also responsible for supplying any information or documentation requested by customs authorities or the delivery carrier.
Customs procedures may extend the estimated delivery time.
If a shipment is refused, remains unclaimed or is returned because the recipient did not pay applicable charges or provide required information, reasonable return-shipping costs, customs charges and carrier fees may be deducted from the refund where permitted by law.
10. RISK AND OWNERSHIP
For consumer orders, the risk of loss or damage passes to you when you, or a third party designated by you other than the carrier, physically receives the goods.
Ownership of the goods passes after full payment and delivery, subject to applicable law.
11. RIGHT OF WITHDRAWAL
If you are a consumer in the European Union or another jurisdiction providing an equivalent mandatory right, you may withdraw from an eligible online purchase without giving a reason within 14 days after the day on which you, or a third party designated by you other than the carrier, receives the goods.
To exercise this right, you must send a clear withdrawal request to [CUSTOMER SUPPORT EMAIL] before the withdrawal period expires.
After notifying us, you must send the goods back within 14 days to:

Do not send a return to any address other than the approved return address or process provided by Kollateral.

12. RETURN CONDITION
You may inspect and try on a garment only to the extent reasonably necessary to establish its nature, characteristics and fit, in the same way that you would normally be allowed to do in a physical store.
Returned products should be:
- unwashed;
- not worn beyond a reasonable fitting;
- free from stains, odours, damage and alterations;
- returned with the original labels, tags and accessories where still available.
Please also return the original packaging where reasonably possible.
You are responsible for any reduction in value caused by handling beyond what is reasonably necessary to inspect the product. A missing tag or damaged packaging does not automatically remove a statutory withdrawal right, but any proven reduction in value may be deducted where permitted by law.
13. RETURN SHIPPING COSTS
The direct cost of a standard withdrawal return is paid by the customer, unless:
- Kollateral expressly agrees to cover it;
- the product received is incorrect, damaged or defective; or
- applicable law requires otherwise.
We recommend using a tracked shipping service. Until the returned goods are received, you remain responsible for proving that the return was sent.
14. REFUNDS
Where a valid withdrawal applies, we will refund the payments received for the returned goods and, for a complete withdrawal from the order, the cost of the least expensive standard delivery method originally offered.
Any additional amount paid for premium or expedited delivery is not refundable beyond the cost of the least expensive standard delivery option, unless applicable law requires otherwise.
Refunds will be issued using the original payment method unless another method is expressly agreed.
We will process the refund within the period required by applicable law. We may withhold the refund until we receive the returned goods or until you provide evidence that the goods have been sent back, whichever occurs first.
For partial returns, original outbound delivery charges are refunded only where required by applicable law.
15. INCORRECT, DAMAGED OR DEFECTIVE PRODUCTS
If you receive an incorrect, damaged or defective product, contact [CUSTOMER SUPPORT EMAIL] as soon as reasonably possible and provide the order number and clear photographs where useful.
Please contact us before returning the product so that we can provide the appropriate return instructions. This request does not limit your mandatory legal rights.

16. LEGAL GUARANTEE OF CONFORMITY
Products sold to consumers are covered by the mandatory legal guarantee of conformity under applicable law.
For consumers in the European Union, this protection applies for at least two years from delivery. If a product is not in conformity, you may be entitled to repair or replacement without charge, or, where the legal conditions are met, an appropriate price reduction or termination of the contract.
Any commercial statement or voluntary warranty offered by Kollateral is additional to, and does not replace, the mandatory legal guarantee.
17. EXCHANGES
Unless an exchange service is expressly offered, products should be returned in accordance with the applicable return procedure and a new order should be placed for the preferred product or size.
Product availability for a replacement order cannot be guaranteed.
18. PROMOTIONS AND DISCOUNT CODES
Promotions and discount codes are subject to any specific conditions displayed with the offer.
Unless stated otherwise, discount codes:
- cannot be exchanged for cash;
- cannot be applied after an order has been submitted;
- may not be combined;
- may be limited by product, customer, quantity, territory or period.
A promotion does not affect statutory consumer rights.
19. LIABILITY
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, or mandatory consumer rights.
Subject to mandatory law, Kollateral is not responsible for indirect or unforeseeable losses that were not reasonably foreseeable when the contract was formed.
If you purchase as a consumer, Kollateral remains responsible for losses that are a foreseeable result of our breach of contract or failure to use reasonable care and skill.
20. EVENTS OUTSIDE OUR REASONABLE CONTROL
We are not responsible for delay or failure caused by events outside our reasonable control, including severe weather, transport interruption, industrial action, customs delays, public-authority action, major technical failure, epidemic, conflict or carrier disruption.
This section does not remove any mandatory right to cancellation, refund or another remedy where applicable law provides one.
21. INTELLECTUAL PROPERTY
All Kollateral names, logos, graphics, photographs, product designs, text and other store content are protected by applicable intellectual-property laws.
Store content may not be copied, reproduced, modified, distributed or used commercially without prior written authorization, except where permitted by law.
22. PERSONAL DATA
Personal data connected with orders and customer support will be processed in accordance with applicable data-protection law and the Kollateral Privacy Policy available at:

23. GOVERNING LAW AND DISPUTES
These Terms are governed by Italian law.
If you are a consumer residing in another country, this choice of law does not deprive you of any mandatory consumer protection available under the law of your habitual residence.
Any dispute will be handled by the courts having jurisdiction under applicable mandatory law. Nothing in this section requires a consumer to bring proceedings exclusively before a court that mandatory consumer law does not permit.
Where available, consumers may also use a competent out-of-court dispute-resolution body.
24. SEVERABILITY
If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply.
The invalid provision will be interpreted or replaced only to the minimum extent necessary to make it lawful and enforceable.
25. CHANGES TO THESE TERMS
We may update these Terms from time to time.
The version applying to an order is the version made available when the order was submitted. Later changes do not retroactively alter an existing sales contract unless required by law or expressly agreed.
